A clinical officer accused of raping a dialysis patient at Pandya Memorial Hospital in Mombasa has been acquitted after a court found that the prosecution failed to prove the case beyond reasonable doubt.
The is after the complainant died before she could testify in the case, leaving the court without her direct account of the alleged incident.
Dias Juma Wabwile was cleared of the charges despite DNA evidence linking him to semen found in a condom recovered from the hospital. His defence that the condom had been used during consensual sex with his wife raised questions that the prosecution did not resolve.
He was charged with sexually assaulted the victim on January 31, 2025 at the facility around 5am. He was also charged with committing an indecent act with an adult, with the prosecution alleging that he inappropriately touched the victim with his hands.
