Residents of Kwale have supported a case opposing plans by the government to prospect for and mine rare earth minerals at the mineral-rich Mrima Hill, warning that the project could threaten their land, water sources, cultural heritage and livelihoods.
The residents, through the Centre for Litigation and Trust, say they have been excluded from discussions on a proposed Kenya-US agreement on the exploration and extraction of rare earth minerals at the site.
They are also concerned about possible radioactive and toxic waste from the mining activities and fear that some residents could be displaced without adequate compensation.
When the matter came up for mention before the High Court, the Attorney-General opposed the case, arguing that it had been filed in the wrong forum and should be struck out.
The court has directed the parties to file submissions on whether it has jurisdiction to determine the dispute.
“Each party will have 14 days to file and serve their submissions,” the court said.

The case will be mentioned on September 16 to confirm compliance with the directive and, if the parties have complied, set a date for the ruling.
