The Environment and Land Court has stopped a club in Nairobi’s Lavington area from playing loud music after a resident complained that noise from the establishment had deprived residents of peaceful sleep.
The court issued a temporary injunction restraining 213 Lounge & Restaurant Ltd from playing the loud music at its premises to entertain patrons pending the filing of a compliance report.
The order followed a petition by Allan Monroe Onyango, who complained that residents of Isaac Gathanju Road had been subjected to loud music and other disturbances from the club until the early hours of the morning.
“On an interim basis, pending the filing of the compliance report, a temporary injunction is hereby issued restraining the first respondent from playing music within their premises to entertain revellers and/or patrons visiting their premises,” the court ordered.
The case will be mentioned on August 13.
Mr Onyango has sued 213 Lounge & Restaurant Ltd, Nairobi City County and the National Environment Management Authority (Nema), accusing the club of disrupting the lives of residents in the area.
The club is located at Lavington Shopping Centre and Estate, at the intersection of James Gichuru Road and Isaac Gathanju Road.
Mr Onyango told the court that the establishment plays loud music throughout the night, disturbing residents living along Isaac Gathanju Road.
