Court Clears Super Metro to Resume Kenya Cinema Terminus Operations

The High Court has dealt a blow to the Nairobi County Government after it quashed a decision blocking Super Metro Limited from accessing the Kenya Cinema matatu terminus along Moi Avenue.

• Justice W. Musyoka ruled that the county government acted abruptly and arbitrarily when it blocked the matatu operator from accessing the terminus on the night of May 25, 2026.
• The judge found that Super Metro had not been given prior notice of the action, reasons for the decision or an opportunity to be heard before the county moved to restrict its access to the terminus.
• The case was filed by Super Metro through an originating motion dated May 25, 2026, supported by an affidavit sworn by its director, Josphat Peter Mukuria.

According to the court documents, Nairobi County had authorised Super Metro to operate its vehicles from the Kenya Cinema terminus through a permit dated March 13, 2024. The permit allowed the operator to use the terminus until further notice, subject to payment of seasonal tickets. The court also found that Super Metro had made the required payments.

However, on the night of May 25, the county allegedly placed a notice blocking the company's matatus from accessing the terminus.

Super Metro argued that the decision was made without notice, a hearing or an opportunity for the company to make representations.

The county government and its Chief Officer for Mobility were named as respondents in the case.

County fails to respond

Although the the county government and its Chief Officer for Mobility appointed lawyer Fredrick Achola to represent them, they did not file a response to the application.
